On the evening of February 28, Senate Bill 5239 passed by a vote of 28-21. The bill is a first step in an effort to put in place a legislative fix to the Hirst decision. The Senate bill is now on its way to the state’s House of Representatives for consideration.
SB 5239 essentially "resets" the law to a day before the Hirst ruling opinion was handed down.
"The reason I brought this bill is to take us back to some common sense water legislation that we had before the Hirst decision," said Sen. Judy Warnick, of Moses Lake, the bill's prime sponsor, on the night of the bill’s passage.
